General Sales Terms and Conditions for Business Customers

The General Terms and Conditions of Business are valid in the version current at the time of conclusion of the contract for all relations between you, dear customer, and us, the company Karner Wein Plus GmbH.

1) Customer profile

The creation of the customer profile is only the first and one-time entry of your data, i.e. you register as a gastronomy and trade customer. Your data will be checked by us and then selected users will receive the access data for the reserved online area. This means that you can view the catering prices at any time and order from us in future without having to enter any further data (apart from your password).
Your data will be treated with the utmost discretion in order to protect your privacy. On request, already registered data can be deleted (see EUROPEAN DATA PROTECTION REGULATION NO. 206/379 (DSGVO)). Control: You have the possibility to get an overview of already placed orders.

2) Product selection

The following products from our range can be ordered: Wines, Wines Rarities, Dessert Wines, Sparkling Wines, Selected Distillates, Beer, Beverages, Mineral Water, Draught Wines, Spirits, Vinegar & Oils and Glasses & Accessories.

3) Processing of the order

The presentation of the products on our site does not constitute a legally binding offer, but a non-binding catalogue. After you have informed yourself about our offer on our homepage and have ordered the desired articles via the shopping cart, you will be asked to enter your data (customs permit or excise duty code for foreign countries) and to make any corrections.

By clicking on the shopping cart, you can add as many items as you wish to the shopping cart. You can remove individual products from the shopping cart at any time. As soon as you confirm the purchase in the shopping cart, the order is sent to us.

The confirmation of receipt of the order follows immediately after the order has been sent and does not yet constitute acceptance of the contract. Only upon receipt of our order confirmation is the contract also accepted on our part.

4) Prices

The gastronomy and commercial prices quoted are in euros, excluding statutory VAT, including sparkling wine and spirits tax (Accisa). Shipping costs are not included - see item 7) Transport costs.

If the country of destination provides for taxes on the ordered goods, the associated obligations are your responsibility.

5) Delivery note | Invoice

You will receive a delivery note and invoice from us containing all information relevant to the order.

If you lose the documents relating to your orders, please contact us by e-mail/fax or telephone. We will gladly send you a copy.

6) Direct delivery | Shipping

Employees of our company deliver directly & free of charge to our gastronomy customers in South Tyrol.

Our shipping partners deliver to Italy, Germany, Austria and other EU countries as well as Switzerland.

As a rule, delivery / dispatch takes place within a few working days. We hope for your understanding if there are delays in delivery due to force
Shipments to post office boxes and/or items held in postal storage are not possible.
Although we assume that the goods will be transported without damage, damage may occur during transport. The shipping partners commissioned by us are insured against this in accordance with Law 286/05 for national transport and in accordance with CMR liability for international transport. Please check the goods carefully when they are handed over by the carrier and sign the transport document only with the addition "subject to reservation" in order to be able to claim any damage within 24 hours. Any defects or damage must be noted on the delivery note and returned to us.

The goods remain our property until full payment has been made.

7) Transport costs | customs clearance

Shipping costs are calculated according to the respective country or region. Quotations will be sent to you after your order has been placed.

For gastronomy customers in South Tyrol, delivery is free of charge.

Foreign shipments of wine to the EU with invoicing to a company:

As wine is subject to excise duty within the EU, the issuing of customs documents is mandatory. You will be charged € 20 for this. If you have an excise duty code (customs number for wine purchases), please inform us of this. Otherwise, we can handle customs clearance via the forwarding agent. The costs for this are an additional 20 € for Germany and 40 € for Austria. Invoicing is VAT-free according to article 41.

Foreign shipments of wine to Switzerland with invoicing to a company:

Please inform us of your GEB number / general import permit.

For purchases of less than 20 litres, a general import permit is not mandatory. For purchases of more than 20 litres, the Swiss Customs Directorate can issue a permit once without a GEB. A declaration for own consumption must be issued.

Customs clearance must always be handled by a forwarding agent.

The charges for issuing the customs documents depend on the invoice amount and quantity; these are to be borne by the customer and paid directly to the forwarding agent in advance.

9) Right of withdrawal and return

You have the right to withdraw from the contract within 14 days without giving any reason by declaring the withdrawal of the purchase contract to us. However, we would appreciate it if you would give us the reason for the withdrawal - it would help us to evaluate our services and optimise our offer.

The period for revocation begins at the earliest with receipt of the goods and a detailed revocation instruction in text form. The timely dispatch of the revocation or the goods shall be sufficient to comply with the revocation period. The revocation must be sent in writing by post, by fax or by e-mail to

to declare your revocation. You are obliged to return the goods after sending the revocation. You must return or hand over the goods to us without delay and in any case no later than 14 days from the day on which you notify us of the revocation of this contract.

Important: You have to bear the costs of returning the goods if the delivered goods correspond to the ordered goods.

12) Protection of minors

The distribution of alcoholic beverages to minors is prohibited by law. We must therefore insist on an age statement. By placing an order for alcoholic beverages, you confirm that you have reached the legal age to purchase them in your country. We do not sell to persons under the age of 18. If the purchaser falsifies the age, the contract is invalid or will be contested by us and we reserve the right to claim damages and to prosecute.

13) Published content

We have links to other sites on the Internet on various pages of our portal. We expressly emphasise that we have no influence whatsoever on the design and content of the linked pages and hereby distance ourselves expressly from all content on linked websites. At the same time, we point out that information and knowledge documents on our web pages do not claim to be complete.

14) Final provisions

By placing an order, you agree that we may store, process and use the data contained on the order form within the framework of the customer relationship.

Should individual provisions of these general terms and conditions or of the contract concluded with you be invalid in whole or in part, this will not affect the validity of the contract or of the remaining provisions. The invalid provision will be governed by the relevant Italian laws. The place of jurisdiction is Bolzano.

15) Information on the Distance Selling Act

In accordance with our legal obligation, we would like to inform you as follows:

  • You are concluding distance selling contracts with the company Karner Wein Plus GmbH. The legal owner is Mr Walter Karner.
  • The company Karner Wein Plus GmbH has its registered office in Prad am Stilfserjoch, Kiefernhainweg 74, South Tyrol-Italy.
  • Italian law is applicable. The place of jurisdiction is Bolzano.
  • We inform you about our products on our website - you are also welcome to contact us by telephone. The actual contract is then concluded when you enquire about and order the goods you want from us via our shopping basket system on the Internet, by e-mail or by fax. With our order confirmation we conclude the contract.
  • We reserve the right of self-delivery and in the event of non-delivery due to force majeure, both parties have the right to withdraw from the contract after a period of three months. We are entitled to make partial deliveries.
  • We indicate the price in Euro without the statutory VAT.
